In these Terms and Conditions, the following terms shall have the meanings set out below unless the context otherwise requires:

• "kuyaph," "we," "us," or "our" refers to the operator of the kuyaph online gaming platform, accessible at kuyaph.vip, and all related sub-domains and applications.
• "Platform" means the kuyaph website, mobile-optimized site, Progressive Web App, and any other medium through which kuyaph's gaming services are delivered.
• "Member," "you," or "your" refers to any individual who has registered a kuyaph account and accessed any part of the Platform.
• "Account" means the registered user account created by a Member through the kuyaph registration process.
• "Real Money Balance" means funds deposited by the Member into their kuyaph Account in Philippine Peso (PHP) that are available for wagering or withdrawal.
• "Bonus Balance" means promotional credits, free spins, or other non-cash incentives credited to a Member's Account by kuyaph, subject to applicable bonus terms.
• "Wager" or "Bet" means any real-money or bonus-funded stake placed by a Member on any game or event available on the Platform.
• "KYC" means Know Your Customer — the identity and age verification procedures kuyaph is required to conduct in accordance with applicable Philippine law and PAGCOR requirements.
• "PAGCOR" means the Philippine Amusement and Gaming Corporation, the primary regulatory authority for gaming activities in the Philippines.
• "Gross Gaming Revenue (GGR)" means the total amount wagered by Members minus the total winnings paid out to Members over a given period.

By accessing the kuyaph Platform, creating an Account, making a deposit, placing a wager, or using any feature of the Platform in any manner, you irrevocably agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any provision of these Terms, you must immediately cease using the Platform and close your Account.

These Terms constitute the entire agreement between you and kuyaph with respect to your use of the Platform and supersede all prior agreements, representations, or understandings, whether written or oral, relating to the subject matter herein.

These Terms should be read in conjunction with kuyaph's Privacy Policy and Responsible Gaming Policy, which are incorporated herein by reference and form part of the overall agreement between you and kuyaph.

In addition to the age requirement, the following eligibility conditions apply to all Members:

• You must be at least 21 years of age at the time of registration and at all times during your membership.
• You must be accessing the Platform from a jurisdiction where online gaming is legally permitted. It is your responsibility to determine whether your participation in online gaming is lawful in your location.
• You must not be an employee, contractor, director, or officer of kuyaph, any of its affiliates, or any game provider whose content is featured on the Platform. Immediate family members of such persons are also ineligible.
• You must be accessing the Platform for your own personal use and must not be acting as an agent or representative for any third party.
• You must not have been self-excluded from kuyaph or any other PAGCOR-regulated gaming operator, or subject to a court order or legal prohibition on gambling participation.
• You must not be a Politically Exposed Person (PEP) subject to applicable anti-money laundering (AML) restrictions unless you have completed enhanced KYC procedures.

kuyaph reserves the right to request proof of age and identity at any time. If a Member is found to have registered while underage or otherwise ineligible, their Account will be terminated immediately, all winnings will be forfeited, and deposited funds may be refunded at kuyaph's sole discretion subject to applicable AML obligations.

To access real-money gaming features on kuyaph, you must register a Member Account. The registration process requires submission of accurate and complete personal information including your full legal name, date of birth, Philippine residential address, and a valid Philippine mobile number.

4.1 One Account Policy

Each individual is permitted to hold one (1) kuyaph Account at any time. The creation of duplicate or multiple accounts by the same individual is strictly prohibited. Where duplicate accounts are identified, kuyaph reserves the right to suspend all associated accounts, void any pending transactions, and withhold balances pending investigation.

4.2 Accuracy of Registration Information

You represent and warrant that all information provided during registration is accurate, truthful, current, and complete. You agree to promptly update your account information if any details change. kuyaph is not liable for losses or delays caused by inaccurate member information on file.

4.3 Identity Verification (KYC)

kuyaph is required under applicable Philippine regulations to verify the identity and age of all Members before processing real-money withdrawals. KYC verification requires submission of at least one of the following Philippine government-issued identification documents:

• Philippine National ID (PhilSys)
• Passport (Philippine or foreign, with Philippine residential address)
• Driver's License issued by the LTO
• SSS, GSIS, or PhilHealth ID
• Voter's ID issued by the COMELEC
• UMID (Unified Multi-Purpose ID)

Additional documentation may be requested for enhanced due diligence purposes, particularly for high-value accounts or where kuyaph's AML systems flag a transaction for review.

You are solely responsible for maintaining the security and confidentiality of your kuyaph Account credentials, including your username, password, and any one-time passwords (OTPs) issued to your registered mobile number.

• You must not share your Account credentials with any third party under any circumstances.
• kuyaph staff will never request your password via chat, SMS, or any other channel.
• You must notify kuyaph immediately via Live Chat or email if you suspect unauthorized access to your Account.
• kuyaph shall not be liable for any losses arising from unauthorized Account access where the Member has failed to safeguard their credentials or delayed reporting suspicious activity.
• kuyaph employs 256-bit SSL encryption on all Platform traffic and applies OTP verification for all withdrawals and sensitive account changes as standard security measures.

kuyaph accepts deposits in Philippine Peso (PHP) via the following payment methods: GCash, PayMaya/Maya, BDO (via Instapay), BPI (via Instapay), Metrobank (via Instapay and PESONet), and USDT (TRC-20 network). Minimum and maximum deposit amounts per transaction are displayed in the Deposit section of your kuyaph Account dashboard and may be updated from time to time.

6.1 Deposit Processing

Deposits made via GCash and PayMaya are credited to your kuyaph Real Money Balance in real time upon confirmation from the payment processor. Bank transfer deposits via Instapay are typically credited within 15 minutes. USDT deposits are credited following network confirmations as required by the TRC-20 protocol.

6.2 Deposit Restrictions

kuyaph reserves the right to refuse, delay, or reverse any deposit where: (a) there is reason to believe the funds originate from illegal activity; (b) the payment method cannot be verified as belonging to the Member; (c) the deposit would breach applicable AML regulations; or (d) the deposit triggers kuyaph's internal risk management thresholds.

6.3 No Third-Party Funding

All deposits must be made using a payment method registered in the Member's own name. Third-party deposits — where the payment account is registered to a different person — are prohibited. Such deposits will be reversed, and the Account may be suspended pending investigation.

kuyaph Members may request withdrawal of their Real Money Balance at any time, subject to the conditions set out in this Section and subject to completed KYC verification.

7.1 Withdrawal Methods and Processing Times

Withdrawal requests are processed to the payment method used for the Member's most recent qualifying deposit, or to a verified account in the Member's name. Standard processing times are as follows:

• GCash / PayMaya: 5 to 30 minutes for requests submitted before 9:00 PM Manila time (PST). Requests after 9:00 PM process by 10:00 AM the following morning.
• BDO / BPI / Metrobank (Instapay): Same-day processing for requests submitted before 4:00 PM PST on banking days. Next banking day for requests received after 4:00 PM or on weekends and public holidays.
• USDT (TRC-20): 15 to 60 minutes following internal approval, subject to blockchain network conditions.

7.2 Withdrawal Conditions

The following conditions apply to all withdrawal requests:

• The Member must have completed KYC verification, including submission of a valid government-issued Philippine ID.
• The minimum withdrawal amount is ₱200 per transaction. Maximum withdrawal limits are disclosed in the Withdrawal section of your Account dashboard.
• Withdrawal of Bonus Balance is not permitted. Only Real Money Balance resulting from completed wagering requirements may be withdrawn.
• kuyaph may request additional documentation before processing large withdrawals as part of its AML compliance procedures.

kuyaph offers bonuses, free spins, cashback offers, and other promotional incentives to its Members from time to time. All bonuses are subject to the specific terms disclosed in the applicable promotion, in addition to the general conditions set out in this Section.

8.1 Wagering Requirements

All bonus credits and free spin winnings are subject to wagering requirements before they can be converted to withdrawable Real Money Balance. The applicable wagering multiple, eligible games, minimum odds (for sports bonuses), and expiry window are stated in each promotion's individual terms. Where a bonus is accepted, the wagering requirement must be completed within the stated timeframe or the bonus and any associated winnings will be forfeited.

8.2 Bonus Abuse

Strategies designed to exploit bonus terms — including but not limited to low-risk wagering, game hedging, or participation by Members with a history of bonus abuse — are prohibited. kuyaph reserves the right to void bonuses and related winnings, and to restrict or terminate Accounts, where bonus abuse is identified.

8.3 Maximum Bonus Withdrawal

Unless stated otherwise in the specific promotion terms, winnings derived solely from bonus funds are subject to a maximum withdrawal cap as disclosed in each promotion. Real Money Balances arising from deposits are not subject to this cap.

All games available on the kuyaph Platform are governed by the individual game rules provided within each game interface, in addition to the following general conditions:

• Electronic game outcomes are determined by certified Random Number Generator (RNG) software independently tested and certified by accredited gaming testing laboratories. kuyaph does not manipulate or interfere with RNG outcomes.
• Live dealer game outcomes are determined by physical dealing performed by certified live dealers in regulated studio environments. All live dealer games are subject to independent oversight.
• In the event of a technical error, game malfunction, or disconnection during play, kuyaph's determination of the valid game outcome shall be final. kuyaph is not liable for losses caused by technical failures outside its reasonable control.
• kuyaph reserves the right to void any wager placed after the game outcome has been determined, or where the wager was placed in error due to a technical fault.
• Minimum and maximum bet limits apply to all games and are displayed within each game interface.

The following conduct is strictly prohibited on the kuyaph Platform. Engaging in prohibited conduct may result in immediate Account suspension, forfeiture of balances, and referral to appropriate law enforcement authorities:

• Use of automated software, bots, scripts, or artificial intelligence tools to place wagers or interact with the Platform in a manner not available to standard users.
• Collusion with other Members or third parties to gain an unfair advantage in any game, including but not limited to coordinated sports betting or poker chip-dumping.
• Money laundering — using the Platform to deposit, wager, or withdraw funds derived from illegal activity, or to cycle funds through the Platform to obscure their origin.
• Arbitrage betting or systematic exploitation of pricing errors, technical glitches, or malfunctions to generate guaranteed profit.
• Creating multiple Accounts for the purpose of claiming multiple bonuses or circumventing account restrictions.
• Using stolen, fraudulently obtained, or unauthorized payment credentials to fund a kuyaph Account.
• Attempting to reverse-engineer, hack, or disrupt the Platform's technical systems, security infrastructure, or game integrity mechanisms.
• Misrepresentation of identity, age, or eligibility during registration or at any subsequent point during membership.

kuyaph is committed to promoting responsible gaming and providing tools to help Members maintain control over their gambling activity. The following responsible gaming features are available to all kuyaph Members through their Account dashboard:

• Deposit Limits: Members may set daily, weekly, or monthly deposit limits. Limits take effect immediately when applied and may not be increased for a minimum of 7 days following the increase request.
• Loss Limits: Members may set maximum loss thresholds over defined periods.
• Session Time Reminders: Automatic notifications after configurable session durations to encourage awareness of time spent playing.
• Self-Exclusion: Members may request temporary exclusion periods (ranging from 24 hours to 12 months) or permanent self-exclusion from the Platform. Self-exclusion requests are processed within 24 hours and cannot be reversed during the elected exclusion period.
• Reality Checks: Optional pop-up reminders during sessions displaying elapsed time and net wins or losses for the current session.

kuyaph strictly enforces the 21+ age restriction and does not knowingly permit access by minors. Members who believe they may have a gambling problem are encouraged to use kuyaph's self-exclusion tools and seek support from relevant resources. Members must exercise their own judgment and accept sole responsibility for their gambling decisions.

Members may close their kuyaph Account at any time by contacting customer support via Live Chat. Upon voluntary closure, any Real Money Balance remaining in the Account will be refunded to the Member's verified withdrawal method, subject to completion of outstanding KYC requirements and absence of any pending investigations.

12.1 Termination by kuyaph

kuyaph reserves the right to suspend, restrict, or permanently terminate any Member Account at its sole discretion, including but not limited to cases where:

• The Member has breached any provision of these Terms and Conditions.
• kuyaph has reasonable grounds to suspect fraud, money laundering, or other illegal activity.
• The Member has provided false or misleading information during registration or KYC.
• The Member has engaged in prohibited conduct as defined in Section 10.
• A regulatory authority or court order requires kuyaph to restrict the Member's access.

12.2 Effect of Termination

Upon termination for cause, kuyaph reserves the right to withhold any balances pending investigation and to forfeit balances where funds are determined to be the proceeds of fraudulent or illegal activity. Balances that are not subject to forfeiture will be returned to the Member's verified withdrawal method following resolution of any investigation.

All content on the kuyaph Platform — including but not limited to the kuyaph name, logo, trade dress, website design, game interfaces, software, text, graphics, and multimedia content — is the exclusive property of kuyaph or its licensors and is protected by applicable intellectual property laws.

Members are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal entertainment purposes in accordance with these Terms. This license does not include any right to:

• Copy, reproduce, distribute, or publicly display any Platform content without prior written authorization.
• Modify, adapt, translate, or create derivative works based on Platform content or software.
• Reverse-engineer, decompile, or disassemble any part of the Platform's technical systems.
• Remove or alter any proprietary notices, labels, or copyright markings on Platform content.

To the maximum extent permitted by applicable Philippine law, kuyaph and its officers, directors, employees, and agents shall not be liable to any Member for:

• Any indirect, incidental, consequential, or punitive loss or damage arising from your use of or inability to use the Platform.
• Loss of profits, revenue, data, goodwill, or anticipated savings resulting from reliance on the Platform or its content.
• Service interruptions, delays, or errors caused by circumstances outside kuyaph's reasonable control, including but not limited to telecommunications failures, payment processor outages, or force majeure events.
• Decisions made by Members in the course of their gaming activity, including any financial losses incurred through wagering.

Nothing in these Terms shall limit kuyaph's liability for fraudulent misrepresentation, willful misconduct, or any other liability that cannot be limited or excluded under applicable Philippine law.

kuyaph reserves the right to modify, update, or replace these Terms and Conditions at any time without prior notice, except where required by applicable law or regulation. The most current version of the Terms will always be available at kuyaph.vip/terms-conditions.

Where amendments are material — meaning they substantively affect Member rights or obligations — kuyaph will endeavour to provide at least 14 days' advance notice via email to the Member's registered address and/or via a prominent in-platform notification. Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised Terms.

If you do not accept an amendment, you must cease using the Platform and may request Account closure in accordance with Section 12. kuyaph will process any remaining Real Money Balance in accordance with its standard withdrawal procedures.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or in connection with these Terms or your use of the kuyaph Platform shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

16.1 Dispute Resolution Process

Before initiating any formal legal proceedings, Members are encouraged to attempt to resolve disputes through kuyaph's internal dispute resolution process:

1. Step 1: Contact kuyaph customer support via Live Chat or by emailing [email protected], describing the dispute in detail and providing any relevant evidence.
2. Step 2: kuyaph's support team will acknowledge your complaint within 24 hours and provide an initial response within 5 business days.
3. Step 3: If the initial response does not resolve the dispute to your satisfaction, you may escalate to kuyaph's management team by requesting escalation in writing.
4. Step 4: If the dispute remains unresolved after the escalation process, either party may pursue resolution through the competent courts of the Philippines.

16.2 Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining Terms, which shall continue in full force and effect to the maximum extent permitted by law.
